Past-Nuptial Agreement

In India, there is no specific statute that explicitly governs or recognizes post-nuptial agreements. Their legal standing is an evolving area, interpreted through the lens of contract law and judicial precedent. For Hindus, who form a significant majority, marriage is traditionally considered a sacrament rather than a contract, which further complicates the enforceability of such financial settlements .

The primary basis for validity is the Indian Contract Act, 1872. For a post-nuptial agreement to be considered legally binding, it must satisfy the conditions of a valid contract under Section 10—namely, free consent of both parties, capacity to contract, and a lawful consideration . The most significant hurdle is Section 23 of the Contract Act, which renders an agreement void if its object or consideration is opposed to "public policy" . Indian courts have traditionally been cautious, often holding that agreements which try to alter the essential duties of marriage or facilitate divorce are against public policy and thus unenforceable . However, the judiciary has shown a slightly more receptive attitude towards agreements that deal strictly with the division of property and financial arrangements, provided they are fair, voluntary, and entered into with full disclosure .

Key Limitations:

• Public Policy: Any clause that appears to encourage divorce or waive the right to maintenance is highly likely to be struck down by a court .
• Override by Personal Law: Provisions in a post-nuptial agreement cannot override statutory rights granted under personal laws, such as the right to maintenance under the Hindu Marriage Act, 1955, or the Bharatiya Nagarik Suraksha Sanhita, 2023 .
• Goa Exception: The only exception in India is the state of Goa, where the Portuguese Civil Code applies and explicitly allows for the registration of pre-nuptial agreements governing matrimonial property .

While a post-nuptial agreement can be a useful record of mutual intent, its enforceability in India is uncertain and largely depends on its specific terms. Courts will scrutinize it for fairness, and any clause that infringes on statutory rights or is deemed contrary to public policy will likely be invalidated
