Transfer of Petition
In India, a transfer petition is a legal remedy sought by a party to move a pending case from one court to another, ensuring convenience, fairness, and the interests of justice . The power to transfer cases is derived from several statutory provisions. For civil matters, Section 25 of the Code of Civil Procedure, 1908, empowers the Supreme Court to transfer suits, appeals, or other proceedings from one High Court or civil court in one state to another.
The High Courts also possess authority under Section 24 of the CPC to transfer cases pending in subordinate courts within their jurisdiction . In criminal law, Section 406 of the Code of Criminal Procedure, 1973, allows the Supreme Court to transfer cases and appeals, while Section 407 empowers the High Courts to do so . Additionally, Article 139A of the Constitution enables the Supreme Court to transfer cases pending in High Courts if they involve the same or substantial questions of law .
Common grounds for seeking a transfer include convenience of parties (such as distance, health issues, or financial constraints), apprehension of bias or lack of fair trial, threats to personal safety, and the need to consolidate multiple related cases to avoid conflicting judgments . The paramount consideration for courts is always the requirement of justice . In matrimonial disputes, the Supreme Court has consistently shown a liberal approach, often transferring cases filed by husbands to the wife's place of residence, considering her convenience, safety, and the interests of minor children . A party must file the petition promptly once grounds arise, as delays may weaken the case . While the availability of video conferencing is a factor, it is no longer an automatic ground to refuse transfer if genuine hardship exists . The petition must be supported by an affidavit and relevant documents, and the court may grant an interim stay of proceedings in the original court pending its decision
