Special Marriage Act
The Special Marriage Act, 1954 is a secular Indian law that provides a civil form of marriage for couples, irrespective of their religion or caste, who wish to marry outside the bounds of their personal laws . Enacted to facilitate inter-caste and inter-religious unions, it allows any two individuals to enter into a marriage without renouncing their faith . The Act lays down specific conditions for a valid marriage under Section 4: neither party must have a living spouse, both must be capable of giving valid consent and be of sound mind, the groom must be at least 21 and the bride at least 18, and the parties must not be within the degrees of prohibited relationship unless their custom permits it
The procedure involves giving a written notice of intended marriage to the Marriage Officer of the district where at least one party has resided for 30 days . This notice is published, and a 30-day period is provided for any objections to be raised . If no objections are upheld, the marriage can be solemnized in the presence of the Marriage Officer and three witnesses, after which a marriage certificate is issued, serving as conclusive legal proof of the marriage . Key legal consequences include that succession to property of individuals married under this Act is governed by the Indian Succession Act, 1925, and for those belonging to an undivided family, it results in severance from the family . The Act also contains comprehensive provisions for divorce, including grounds for fault and divorce by mutual consent after one year of separation
